Lorosa Coast Terms and Conditions

The following terms and conditions apply to any property, tour, transfer or inclusion on the

http://www.lorosacoast.com.au website or that is included in your quote from Lorosa Coast.

IMPORTANT NOTE: Conditions including final payment / deposit / cancellation and

amendments may vary depending on Resort or brand and properties reserve the right to

amend their policies at any time.

COVID-19

These terms and conditions apply to all travel dates and circumstances. No additional refunds

or compensation will be available if travel bans are reinstated or if you or part of your group

becomes unwell and is unable to travel *within non cancellation time frames.

Accommodation, tours and transfers are booked with the understanding that COVID-19 and

other illnesses may impact your future travel plans and payment of the deposit constitutes

acceptance of these terms.

How to book / quotes and reservations

Lorosa Coast acts as an agent on behalf of hotels, resorts, property owners and property

managers who provide accommodation services. We do not own or manage properties. The

majority of properties in our portfolio are privately managed and check in is not through hotel

reception but through the offsite property manager which may require you to visit their office

for registration and key collection. Please keep this in mind if you are arriving by airport

coach transfer as you may need additional transport to the accommodation.

Quotes and reservations are subject to availability and actual pricing at the time of booking.

Quotes are valid for 48 hours however some prices are dynamic and change daily. Any verbal

or written quote given is an estimate only of the price, which will be subject to written advice

on confirmation of the reservation from your travel consultant.

We only accept reservation requests in writing and bookings will be confirmed via email,

hello@lorosacoast.com.au, or through an employee of the business with a personal company

email account.

Deposit

A minimum deposit of $200 per room (unless otherwise advised) must be received within 24

hours of making the booking. Payment of this deposit will indicate acceptance of these

booking conditions. This deposit is non-refundable and non-transferable. For travel dates less

than 30 days ahead, bookings must be paid in full at the time of requesting a reservation.

Deposit amounts vary from property manager to property manager.

Lorosa Coast bear no responsibility for monies paid until cleared funds are received in the

account of Lorosa Coast .

Final payment

Full payment will be due 5-6 weeks before the date of travel. Lorosa Coast will send you

emails to remind you.

Confirmation and invoices are subject to re-issue if incorrect through error or omission and

the passenger accepts the liability to then pay the correct cost or to decline to retain the

reservation.

If a customer fails to pay monies when owed, Lorosa Coast and/or the property manager

reserves the right to deem this as a cancellation and cancel the booking without further

communication. Should this happen, the customer will forfeit his/her deposit to Lorosa Coast.

If an unpaid booking is cancelled within 30 days of the arrival date of the booking, or within

the specified non refundable period, Lorosa Coast reserves the right to pursue payment of

outstanding monies.

Payment options

Payments accepted include direct bank transfer and credit/debit card through a merchant

facility. A Credit card surcharge may be payable and this will be reflected at the time of

payment. Prices quoted are in AUD and all payments must be made in AUD. Some properties

or brands where the balance is due on arrival may also have a credit card surcharge for

balance payments.

Cancellations

If you choose to cancel or terminate your holiday earlier than expected and for whatever

reason, the following fees shall apply. Please note cancellation charges vary from property

manager to property manager and it is your responsibility to review both these terms and

conditions and any additional terms and conditions we send you at the time a reservation is

made.

Cancellation fees for holiday apartments and holiday homes unless otherwise arranged are as

follows:

30 days or more before arrival – full refund less the $200 initial deposit.

Less than 30 days before arrival – full payment.

Amendments to date or property

Up to 30 days prior to check in – $25 + GST amendment fee (subject to availability) – this

may vary dependent on the individual resort or brand requirements. Cancellation or

termination will not be considered an amendment. Within 30 days prior to check-in –

amendments may not be accepted depending on the property or brand being booked and will

be based on the situation at the time and availability.

If a refund is due to the client after a cancellation, any money will be refunded to the client

after it has been received back from the supplier. This can sometimes take two weeks or

more.

Rates & changes

All rates featured are subject to change. Prices and conditions are correct at time of printing

but are subject to change without notice. Prices listed are in Australian Dollars and are

inclusive of GST where applicable.

All reservations do not include transport from your home port to holiday destination and

return, items of a personal nature, meals (unless specified), transfers and existing or proposed

taxes and government charges, unless otherwise indicated.

Any verbal quote given is an estimate only of price, which will be subject to a written advice

on confirmation of the reservation. The price of your holiday cannot be guaranteed until

confirmation payment is received. All prices and other payments and conditions should be

confirmed with your travel consultant at the time of booking.

Guests may be required to provide a credit card imprint on arrival to cover any miscellaneous

charges. Where a credit card is not available a cash deposit will be required. In addition, an

acceptable form of photographic identification will need to be produced at the resort prior to

check-in. This rule may also apply to privately managed apartments.

Accommodation

Whilst care is taken to ensure that the description of facilities and services of the

Resorts/Complexes are accurate, these are continually being changed, upgraded, and on

occasion taken out of service.

Lorosa Coast can not be held liable if an Apartment or Holiday House is taken out of service

for any reason including but not limited to being sold, changing property managers or

undergoing emergency or planned maintenance. If this should occur, our consultants will do

everything possible to assist with other options at the earliest possible opportunity. A

property manager reserves the right to move a booking from one apartment to another of

similar quality and facilities should the need arise due to any of the above reasons. Lorosa

Coast may not be advised of apartment number changes and cannot be held liable if a

property manager moves a booking to another apartment.

If any feature/facility is essential for the guest in choosing a particular property, it is

advisable that the guest checks this with their travel consultant at the time of booking. Lorosa

Coast cannot be held liable for omissions or errors, whether temporary or permanent of a

property’s facilities and services. Property room photos may not be specific to the actual

room allocated. Photos are indicative only. Accommodation facilities listed may not apply to

all room types.

If a customer arrives at the property and does not like the accommodation that he/she has

chosen, he/she will be liable for the full balance owed, unless it can be proven without a

reasonable doubt that he/she did not get what was promised on the Confirmation Form or

what was depicted on the website, with consideration to the following:-

The majority of properties are strata titled. This means that each apartment within the various

complexes is owned by a different person. Because of this, the furnishings in each apartment

can vary. On our website we have displayed photos of typical apartments. These are neither

the best apartments, nor the worst. The photos are used as a guide only, and neither Lorosa

Coast or the property manager can be held responsible if a particular apartment does not look

exactly like the photos on our websites. As strata titled apartments, they are subject to sale

and property management changes without notice. Although Lorosa Coast will endeavour to

move an existing booking should this occur, there may be times when this is not possible.

Should the property manager advise that the booking cannot be honoured and Lorosa Coast

can not provide an alternative apartment of the same standard or provide an alternative

property that is acceptable to the guests, we will provide a full refund for any money paid.

Lorosa Coast will not be liable for the inconvenience or loss of any money for flights, car hire

or incidentals should accommodation need to be cancelled. A confirmed booking does not

preclude circumstances where an apartment/house becomes unavailable or a property

manager withdraws a reservation confirmation. The customer agrees that the accommodation

is booked only for the number of people actually stated on the Confirmation. Any additional

people will be charged for at the applicable property nightly rate.

Children and Infants

In most cases, children’s prices for accommodation featured on this site refer to children

occupying the same room/unit with at least one adult and using existing bedding. Additional

charges will apply if extra beds or linen (including rollaways, sofa beds or cots) are required.

Prices for any other combination of children and adults should be obtained from your travel

consultant. The definition of a ‘child’ or ‘ínfant’ is determined by the property/owner and ages

may vary. It is important that you disclose the accurate number of people who will stay in the

property to avoid additional charges from the property manager.

Weather

Please review the local weather average for your trip dates. Far North Queensland is known

for its wet season, cyclone season and stinger season. These events are rare and the area is

still magnificent to visit throughout the year, however Lorosa Coast will not be responsible

for financial loss due to cancelled or delayed travel caused by weather events and

accommodation, tour and transfer balances will remain your responsibility. Please consider a

domestic travel insurance policy that includes these events.

Special requests

Whilst we attempt to satisfy all special requests, we are unable to provide a guarantee.

Please review special events around your dates of travel to ensure your stay is not interrupted

or disturbed. Note; The Cairns Ironman is held in early June. Australian school holiday dates

are available online in advance.

Maps & Images

Map images, if shown, are for general information and may not necessarily reflect actual

routings, locations or services provided. Many of the destination shots featured on this site

have been supplied by tourism authorities, including Tourism & Events Queensland &

Australian Tourism.

Travel insurance

We strongly recommend you purchase comprehensive travel insurance at time of booking.

We suggest that the policy should include, but not be limited to, the following cover: Loss of

deposit through cancellation; loss or damage to personal baggage and loss of money and

medical expenses.

Not included in price of holiday

Airport taxes, costs of a personal nature e.g. laundry, taxis, telephone calls, room service.

Meals and transport are not included in the rates however some Resorts do have these as part

of the package.

Booking arrangements

The person effecting a booking shall be deemed to have accepted the booking conditions on

behalf of all persons named in the booking.

Documentation

Travel documents and check in instructions will be forwarded by email when full payment is

received.

Under 18’s

All clients under the age of 18 must be accompanied by a parent/guardian or an individual

over the age of 18, the property has the right to refuse any booking, when the legal guardian

over 18 cannot provide current photo ID if requested. Some property managers require the

booking client to be over 23 years of age. If you are in doubt, please check before proceeding

with the booking.

Package prices / per night prices

Total or Per night prices are to be used as an indicator only and not as an extra night rate.

Responsibility

Lorosa Coast can sometimes include third party products in special packages. As an agent on

behalf of this product or service Lorosa Coast shall not be liable under any circumstances for

any failure by those service providers to fulfil such travel arrangements nor for any error,

alteration or change of any kind made by those service providers following the acceptance of

the booking by them. All coupons, vouchers, receipts and tickets are issued subject to the

terms and conditions specified by those service providers. Lorosa Coast both for itself and on

the behalf of their employees or agents do not accept any responsibility for any act, omission,

default or neglect of themselves, their employees or agents for injury, damage, or loss to

persons or goods whatsoever or however the same may be caused and they do not warrant

and are in no way responsible for the accuracy of any information given in statement made by

their service providers in terms of travel arrangements. By utilising the travel services

provided by Lorosa Coast, you agree that:

Lorosa Coast shall not be liable for the wilful or negligent acts and/or omissions of

suchcarriers and/or service providers. Lorosa Coast will not be liable for any accident, injury,

delay, property damage or personal loss to you or those travelling with you in connection

with any accommodation, transportation, or other travel services resulting directly or

indirectly from any occurrences or conditions beyond its control, including but not limited to

acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil

disorder, disaster, Government regulations or changes in itinerary or schedule. Please note

that all travel documents, observance of laws and regulations of various Governments are

your responsibility.

Lorosa Coast only accepts instructions on the above terms.

Lorosa Coast has a separate Complaints Resolution Process for any complaints about our

service or the services supplied through our suppliers.
